1. Who we are

The Ascent Construction Platform (the “Platform”) is operated by Ascent Construction Group(“Ascent,” “we,” or “us”). We are a general contractor based in Arizona. The Platform is a private project-management tool used by Ascent personnel and the subcontractors, vendors, owners, designers, and other parties working on our active projects (collectively, “Users”). The Platform is not a consumer product and is not directed to the general public.

2. Information we collect

We collect only information necessary to operate the Platform:

  • Account information— name, email address, mobile phone number, employer, role, and password (stored only as a one-way hash). Provided by you, by your employer, or by Ascent personnel during project onboarding.
  • Project information— documents, photos, drawings, schedules, RFIs, submittals, punch list items, daily reports, meeting minutes, and other content you upload, draft, or comment on. Photos may include device-stamped EXIF metadata (date, time, GPS).
  • Communications— the contents of emails and SMS messages we send you, delivery and engagement metadata returned by our carriers (e.g., bounce, click, opt-out events), and any reply content you send to those messages.
  • Technical information— IP address, browser type, device type, pages viewed, and approximate timestamps of activity. Used for security, debugging, and access auditing only.

3. How we use information

  • To operate the Platform and provide its features.
  • To send transactional and project-operations communications — account invitations, password resets, RFI/submittal notifications, schedule distributions, punch list assignments, daily reminders, and similar project-management messages.
  • To prevent unauthorized access, investigate suspected misuse, enforce our Terms & Conditions, and protect our rights and the rights of other Users.
  • To comply with legal obligations and respond to lawful requests from governmental authorities or in connection with litigation, audits, or insurance claims involving Ascent or a project.

We do not sell or rent personal information. We do not share your information with unaffiliated third parties for their own marketing purposes. We do not use SMS opt-in data for any purpose other than the operation of the SMS feature you opted into.

4. SMS / text messaging

The Platform sends SMS text messages to mobile numbers added by Ascent personnel (or by your employer) to a project’s SMS distribution list. Typical messages include daily punch list reminders, distribution notifications, and other transactional, project-related alerts.

  • Consent.You are added to a project’s SMS list only after your mobile number has been provided to Ascent — either by you during onboarding or by your employer (for example, your office manager submits your number when you are designated as a project foreman). By providing the number for that purpose, you consent to receiving SMS at that number from Ascent in connection with the project. Consent to receive SMS is not a condition of any sale, employment, or contract.
  • Frequency.SMS frequency varies by project and role. For the daily punch list reminder, recipients receive at most one message per project per day, sent at the project’s configured local time. Other transactional alerts are event-driven and infrequent.
  • Carrier rates. Message and data rates may apply. Ascent is not responsible for carrier charges incurred by recipients.
  • Opt-out. You may opt out at any time by replying STOP to any Platform SMS. The carrier will block further messages and we will record the opt-out on our side. Reply HELP for assistance, or contact us using the information in Section 1.
  • Carrier processing. SMS is delivered via our third-party telecommunications provider (currently Twilio Inc.) and its carrier partners. Phone numbers and message content are transmitted to and processed by Twilio for the sole purpose of delivering and confirming the message.
  • No mobile-data sharing.Mobile information collected for SMS purposes — including phone numbers and opt-in/opt-out status — is not shared with third parties or affiliates for marketing or promotional purposes, and is not sold.

5. Service providers

We use a small set of vetted service providers to operate the Platform. Each is bound by confidentiality and data-protection obligations and may access information only as needed to provide its service:

  • Cloud hosting and database (current providers include Vercel, Railway, and Amazon Web Services).
  • Email delivery (current providers include our SMTP relay and unsubscribe handler).
  • SMS delivery (currently Twilio Inc.).
  • Authentication (NextAuth-managed sessions).

We may change service providers at any time. We will not transfer your data to a provider whose practices are materially less protective than those described in this policy.

6. Cookies and similar technologies

We use strictly-necessary cookies to keep you signed in and to protect against cross-site request forgery. We do not use third-party advertising cookies, and we do not deploy tracking pixels for marketing purposes.

7. Security

We employ commercially reasonable administrative, technical, and physical safeguards to protect information against unauthorized access, including encrypted transport (TLS), encrypted-at-rest storage for sensitive fields, hashed passwords, role-based access controls, and access logging. No system is perfectly secure; you use the Platform subject to that risk and the limitation of liability set out in our Terms & Conditions.

8. Retention

We retain account and project information for the duration of the underlying project and for a period afterward consistent with the statute of repose for construction claims in the relevant jurisdiction (in Arizona, currently eight years from substantial completion) plus a reasonable margin. Operational and security logs are retained for shorter periods and rotated. You may request earlier deletion of your personal account information using the contact information in Section 1; we will accommodate the request to the extent it does not conflict with our retention obligations or legitimate interests (including dispute defense).

9. Your rights

Depending on your state of residence, you may have the right to request access to, correction of, or deletion of personal information we hold about you; to opt out of certain processing; and to designate an authorized agent to make those requests on your behalf. To exercise a right, contact us using the information in Section 1. We will verify your identity using account-level information already on file before fulfilling a request, and will respond within the time required by applicable law.

We do not knowingly engage in “sales” or “sharing” of personal information as those terms are defined under the California Consumer Privacy Act (CCPA), and we do not use sensitive personal information for any purpose beyond what is reasonably necessary to operate the Platform.

10. Children

The Platform is not directed to, and we do not knowingly collect information from, individuals under the age of 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.

11. Jurisdiction

The Platform is operated from the United States and is intended for use in the United States. If you access the Platform from outside the United States, you consent to the transfer of your information to the United States and to its processing under United States law.

12. Changes to this policy

We may update this policy from time to time. The “Last updated” date at the top reflects the current version. Material changes will be communicated by email, in-Platform notice, or both. Continued use of the Platform after a change becomes effective constitutes acceptance of the updated policy.
